The website www.vedetta.org (“Vedetta.org”) is the exclusive property of Ultimo SRL Via Isonzo, 32 – 00198 Rome (RM)
This “Terms and Conditions document” (together with any additional conditions applicable) governs the use of Vedetta.org by the user, or each individual who accesses it and prepares to explore and use it (“User”).
From the moment the User accesses Vedetta.org, the Terms and Conditions document constitutes a legally binding contract between the User and Vedetta.org and applies without exception to all browsing activities within the site, to those, further regulated, relating to the insertion of content, to those, further regulated, relating to registration and to those, further regulated, relating to the use of free or paid services ("Services").
Users who do not fully accept the Terms and Conditions document are not authorized to explore and use Vedetta.org, nor to carry out any activity within the site, nor to benefit from its Services.
By accepting the Terms and Conditions document and subsequently registering on Vedetta.org or subscribing to the Services, the User simultaneously authorizes Vedetta.org to send him/her informative communications, including those relating to changes to the Terms and Conditions, via email or regular mail, without prejudice to the provisions of the Privacy section.
The contents of Vedetta.org (“Contents”) include, by way of example but not limited to, the site in its entirety and in all its parts, LIVE webcam footage, videos, image sequences, images taken individually, text content, photos, graphic elements, sound and musical content and other material viewable or accessible through the site.
Vedetta.org is the sole and exclusive owner of the proprietary rights on all the Contents of Vedetta.org, with the exception of the contents belonging to third parties.
Changes to Vedetta.org and the Terms and Conditions document
Vedetta.org reserves the right to modify the Contents of Vedetta.org and the Terms and Conditions document at any time.
From the moment of its publication in this section, the modified version of the Terms and Conditions document will be automatically and legally binding for the User towards Vedetta.org and will apply without exception to all browsing activities within the site, to those, further regulated, relating to the insertion of contents, to those, further regulated, relating to registration and to those, further regulated, relating to the use of the Services, as well as to all other new and/or different activities introduced with the modification.
Users who do not fully accept the Terms and Conditions document as amended will not be authorized to explore and use Vedetta.org, nor to carry out any activity within the site, nor to benefit from its Services, and will therefore be required to request the cancellation of any registration and/or any subscription to the Service.
Ownership of Content
Vedetta.org and its Contents are the exclusive property of Vedetta.org, except for content belonging to third parties who provide services to the same, and are protected by the laws in force regarding intellectual property and copyright. All related rights are reserved, except where otherwise indicated. All Contents consisting of trademarks, logos or other distinctive signs are trademarks, logos or other distinctive signs belonging to Vedetta.org or to third parties who have granted the related rights to the latter. Any use of the Contents by the User, unauthorized or carried out in violation of the provisions of this document Terms and Conditions and the laws in force regarding intellectual property and copyright, is prohibited.
With regard to the Contents inserted by the User, for example photos and videos, the User acknowledges and agrees to be the sole responsible for his/her Contents and the consequences of their uploading on Vedetta.org. Vedetta.org expressly declines any and all liability in relation to said Contents.
The User acknowledges and guarantees that he/she is in possession of all necessary licenses, authorizations, rights, consents and permissions to allow Vedetta.org to use the Contents uploaded by the User in the manner provided for by this Terms and Conditions document as well as by the specific conditions of each area that collects said Contents, when they exist.
The Content uploaded by the User may not contain any material that is copyrighted by third parties or subject to other proprietary rights of third parties (including rights of privacy or rights of publication), unless the User has a formal license or authorization by the legitimate owner.
You further acknowledge and agree that while browsing Vedetta.org you may be exposed to Content that is factually inaccurate, offensive, indecent, or otherwise objectionable. You agree to waive, and by accepting these Terms and Conditions you hereby waive, any legal or equitable rights or remedies you have or may have against Vedetta.org in the event of such circumstances arising from such Content.
Use of the Site Contents
Permitted Uses of Content. Vedetta.org authorizes Users to view all Content on Vedetta.org and, where sharing links are present, to share live webcam images only through such links.
Unauthorized Uses of Content. Except as expressly permitted by Vedetta.org, the User may not download, extract, photograph, print or make copies of any Content, including image sequences, individual images, text, video, photos, graphics or any part thereof, either for commercial purposes or for personal use.
With reference to all the Contents, it is forbidden to use them, modify them, adapt them, reformat them, download them, reproduce them (even in partial form), transmit them, publish them, transfer them, copy them, sell them, exploit them, transmit them, create videos and / or montages and / or photographic compositions and / or photographs, disseminate them in any form, format or medium (paper and digital), through any means of communication (by way of example, Internet, TV, print). Any reproduction of frames generated by webcams, extrapolated or captured through photography, screenshots or any other device or tool capable of capturing single images, image and video sequences is also prohibited.
You may not exploit trademarks, logos or other distinctive signs owned by Vedetta.org, nor use (in any form or by means of any technology) Contents of the Site by removing trademarks, logos or other distinctive signs owned by Vedetta.org.
Use of the Site
Vedetta.org has the purpose of information, communication and entertainment.
The User undertakes to use Vedetta.org in compliance with the following restrictions:
- You may not use Vedetta.org to introduce obscene, abusive, defamatory, or pornographic material, or for any purpose that would constitute a criminal offense or give rise to civil liability or otherwise violate applicable law. In such cases, Vedetta.org will actively cooperate with law enforcement authorities to identify anyone who posts or transmits such material to Vedetta.org.
- you may not use Vedetta.org to solicit commercial business or in connection with a commercial activity, except as and under the conditions established by Vedetta.org;
- you are not permitted to make any modifications or alterations to any part of Vedetta.org, including, but not limited to, the software, the Player that reproduces live webcam images and its related technologies;
- you may not upload, publish or otherwise make available on Vedetta.org any works or materials protected by copyright, trademarks or other proprietary rights, without the written permission of the legitimate owners;
- You may not interfere or attempt to interfere with the proper working of Vedetta.org or any activity conducted on or through Vedetta.org, disrupt the normal flow of interaction, or act in a manner that negatively impacts Users' ability to regularly post messages or other content.
With regard to the interactive sections of Vedetta.org, Vedetta.org reserves the right to monitor or view from time to time comments, discussions, chats, broadcasts and, in general, any other interactive activity carried out through Vedetta.org. In any case, Vedetta.org does not assume any obligation to monitor and view such activities and does not assume any responsibility for the Contents of such sections of Vedetta.org. In particular, Vedetta.org does not assume any responsibility for the presence of materials introduced by third parties in such sections that may have obscene, defamatory, injurious, false, pornographic or otherwise contrary to law and morality content.
In any case, the User is expressly prohibited from introducing or transmitting on Vedetta.org materials of the type described above.
Responsibility of the User
The User who registers on Vedetta.org is obliged to indicate only the personal data requested and guarantees that they are true, correct and updated. The User acknowledges that he is responsible for any use of Vedetta.org by him or by anyone who uses his personal data.
Warranty exclusion
Vedetta.org is provided “as is” and Vedetta.org makes no warranties or representations regarding the operability, accuracy, completeness, or reliability of the Vedetta.org Content.
Limitation of Liability
To the extent permitted by applicable law, Vedetta.org will not be liable for any damages of any kind arising from the use of Vedetta.org, including direct, indirect, incidental and consequential damages.
The weather forecasts for tourist locations published on Vedetta.org, which can be viewed at the bottom of the webcam images, are obtained using advanced software and equipment. However, due to the dynamic nature of atmospheric phenomena and the complexity of the related processing, the User acknowledges and accepts that the published forecasts may be subject to inaccuracies and/or errors. Therefore, Vedetta.org cannot be held responsible in any way, nor can any request for compensation for damages be made, if the weather forecasts consulted by the User prove to be inaccurate.
The webcam is configured as an observation point with an exclusively landscape and promotional / weather nature. The activity of recording images for promotional-tourist-weather purposes through the chosen webcam does not allow to recognize any somatic traits (as prescribed by the Provision on video surveillance - 8 April 2010 - issued by the Privacy Guarantor under the item “4.5. Use of webcam or camera-online for promotional-tourism or advertising purposes "4.5. Use of webcam or camera-online for promotional-tourism or advertising purposes)
Finally, the camera does not perform any video surveillance purposes nor does it have a resolution such as to allow the recognition of the faces of the people possibly framed and / or vehicle license plates.
Linking to third party sites
Vedetta.org contains links to third party sites. Vedetta.org does not exercise any control over them and, therefore, is in no way responsible for the contents of these sites. The User who decides to access a third party site, through a link published on Vedetta.org, does so at his own risk.
Privacy
All data provided by the User to Vedetta.org will be used as provided in the section Privacy. Any material that the User uploads to Vedetta.org will become the property of Vedetta.org which may therefore use it for any legitimate purpose.
Governing Law and Competent Court
This document Terms and Conditions for the use of Vedetta.org has been drawn up and regulated and must be interpreted according to Italian law and the current regulations on intellectual property and copyright. Should any disputes arise regarding the validity, interpretation and execution of this document Terms and Conditions, the matter will be referred exclusively to the competent Judge of the Court of Catanzaro (Italy).
Additional terms and conditions
Additional terms and conditions, other than those provided for in this document, may apply to activities relating to the insertion of Content, to those relating to registration and to those relating to the use of the Services, and the User is required to comply with them.
